Welcome to Lions Den Mobile and Online Notary Services ("we," "us," "our"). These Terms of Service ("Terms") govern your use of our website, mobile notary services, Remote Online Notarization (RON) services, and Apostille Facilitation and Courier services (collectively, the "Services").

By scheduling, using, or paying for our Services, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully.

1. Description of Services

• Notary Services: We provide professional, legally compliant notarial acts as commissioned by the State of Texas for both in-person (Mobile) and remote online (RON) signings.
• Apostille Facilitation: We act as your agent to manage the submission and retrieval of your documents to the Texas Secretary of State for the purpose of obtaining an Apostille or Certificate of Authentication. This includes a review of your documents for common errors before submission.
• Apostille Courier: We act as your transport agent to securely hand-deliver your prepared documents to the Texas Secretary of State and retrieve them once processed.

2. No Legal Advice

Lions Den Mobile and Online Notary Services, its owner, and its agents are not attorneys licensed to practice law in the State of Texas. We are strictly prohibited from providing any legal advice, explaining the contents of documents, or assisting in the preparation or completion of any document. Any information provided on our website or during our services is for educational and procedural purposes only and should not be construed as legal advice. We strongly recommend you consult with a qualified attorney for any legal questions.

3. Payment Policy

• Mobile & Remote Online Notary Services: Payment for all standard notarial acts is due in full immediately upon completion of the service. For RON services, notarized documents will not be released until payment is successfully processed.
• Apostille Facilitation & Courier Services: A non-refundable deposit of 50% of the total service fee (including our fee, state fees, and estimated shipping) is required before any facilitation or courier work begins. The remaining balance is due upon retrieval of the completed document from the Secretary of State, before it is shipped back to you.
• Travel & Ancillary Fees: Any agreed-upon travel fees, printing fees, or shipping costs are separate from notarial fees and are due immediately. If a notarization cannot be completed for reasons not attributable to the notary (e.g., lack of ID, signer refusal), the travel fee is still due.

4. Apostille Service Turnaround Times

We are committed to providing a swift and efficient service. Our standard turnaround goal is three (3) business days from the time we receive your compliant documents and initial payment to the time we retrieve the completed Apostille from the Secretary of State.

However, this is an estimate and not a guarantee. The maximum expected turnaround time is five (5) business days. Turnaround times are subject to the processing speeds, workload, and any unforeseen closures of the Texas Secretary of State's office, which are beyond our control.

5. Your Responsibilities

• For Notary Services: You are responsible for providing a complete, unsigned document (for Jurats) or a signed document (for Acknowledgments), presenting a valid, unexpired government-issued photo ID, and ensuring any required witnesses are present.
• For Apostille Services: You are responsible for providing the correct, original document that meets the requirements of the Texas Secretary of State. We will facilitate the process based on the document you provide. Rejections by the Secretary of State due to issues with the document itself (e.g., incorrect underlying notarization, wrong type of certified copy) are not the responsibility of Lions Den Notary, and our service fees for the completed trip and facilitation are non-refundable.

6. Limitation of Liability

Lions Den Mobile and Online Notary Services' liability is limited to the fees paid for the service. We are not liable for any indirect, incidental, or consequential damages, or for any errors or invalidity of documents resulting from incorrect information provided by you or from the document's own content. Our role is limited to the proper performance of the requested notarial or administrative act.

7. Privacy

Your use of our Services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information in accordance with Texas law. By using our services, you agree to the terms of our Privacy Policy.

8. Changes to Terms

We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to our website. Your continued use of our Services after changes are posted constitutes your acceptance of the new Terms.

This Privacy Policy has been designed to comply with the data privacy, security, and record-keeping requirements set forth in the controlling Texas statutes and administrative rules. Specifically, our practices are governed by:

2. Information We Are Required to Collect

To perform a lawful notarial act in Texas, we are legally obligated to collect specific personal information.

A. Information to Identify You and Your Document(s):

• Contact Information: Your full name, email address, phone number, and physical address.
• Document Information: We must view your document to record its title and date for our notarial record. We do not retain copies of your documents unless it is part of the legally required recording of a Remote Online Notarization.
• Information for Identity Verification: To perform a valid notarial act, we must positively identify you through one of the methods prescribed by law:
  • For Traditional/Mobile Notarization: Personal knowledge of you, or by examining an unexpired government-issued identification (e.g., driver's license, passport) containing your photograph and signature.
  • For Remote Online Notarization (RON): As required by law, identity is verified through: (1) our personal knowledge of you; or (2) a two-step process involving analysis of your government-issued ID (credential analysis) and answering a series of knowledge-based authentication (KBA) questions.

B. Information for the Official Notarial Record:

As required by Texas law (Government Code §406.014), we maintain a secure record of every notarial act performed. This legal requirement applies to all services we offer:

• For Traditional/Mobile Notarizations: A physical, bound journal is kept with a detailed entry for each notarization.
• For Remote Online Notarizations (RON): A secure electronic record, which serves as the electronic journal, is kept for each online notarization in compliance with both §406.014 and the specific RON statutes.

This record includes, as required by law, the date of the notarization, the name and address of the signer, how their identity was verified, the type of notarial act, and the title of the document.

C. Payment Information:

Payment card details are collected by our secure third-party payment processor to bill you for services. We do not store full payment card details on our systems.

3. How We Use Your Information

Your information is used strictly for the purposes of performing our official duties and managing our services:

• To Perform Lawful Notarial Acts: To verify your identity and the details of the instrument as required by the Texas Civil Practice & Remedies Code, Ch. 121.
• To Comply with Legal Record-Keeping: To create and maintain the official notarial record as mandated by Texas Government Code, Ch. 406 and Texas Admin. Code, Ch. 87.
• To Manage Services and Communicate: To schedule appointments, process payments, and respond to your inquiries.

4. How We Share Your Information and Public Access

We do not sell your personal information. Sharing is limited and often legally compelled.

A. Service Providers:

We share information with state-approved RON platform providers and payment processors who are contractually bound to protect your data.

B. Legal and Regulatory Compliance:

We will disclose information to law enforcement or government officials in response to a subpoena, court order, or other legal process.

C. Public Access to Notarial Records:

This is a critical component of Texas Notary Law. Entries in a Texas notary's record are public information. In accordance with Texas Government Code §406.022 and Texas Administrative Code §87.52, we are legally obligated to:

• Provide a certified copy of an entry from our notarial record (either the physical journal or the RON electronic record) to any person who requests it.
• The requesting person must provide the name of the signer and the date of the notarization and pay the legally stipulated fee.

By using our notarial services, you acknowledge that the non-financial details of your notarization are part of a public record and must be provided upon a valid request.

5. Data Security

We take our legal duty to protect your information seriously. In compliance with Texas Admin. Code §87.50, we implement and maintain reasonable security measures:

• RON Security: All RON electronic records, including video recordings and our electronic seal, are protected from unauthorized access using secure, state-compliant technology with encryption and access controls.
• Physical Security: Our physical notarial journal is stored in a secure, locked location at all times.

6. Data Retention

We retain records for the period mandated by law.

• Remote Online Notarization (RON) Records: As mandated by Texas Government Code §406.108, we securely retain the electronic record of an online notarization, including the video recording, for a period of five years from the date of the act.
• Traditional/Mobile Notary Records: Our physical journal is retained for a period consistent with professional best practices (at least five years) to ensure a complete record and for legal protection.

After the required retention period, all records are securely and permanently destroyed.

7. Your Rights and Limitations

While you have rights regarding your data, these rights are limited by our legal obligations as notaries.

• Access to Records: You may request a certified copy of your entry in our notarial record, subject to the same requirements as any public request.
• No Alteration or Deletion: By law, a completed entry in a notarial record cannot be altered, corrected, or deleted. The record must be preserved exactly as it was created at the time of the notarial act.

8. Children's Privacy

Our services are generally not directed to individuals under the age of 18. We do not knowingly collect personal information from children under the age of 13 in compliance with the Children's Online Privacy Protection Act (COPPA). In the specific event that we are requested to perform a notarial act for a minor as permitted by Texas law, we will do so only with the consent and typically in the presence of the minor's parent or legal guardian. Any information collected as part of such a lawful notarial act will be subject to the same protections, retention, and public access rules described in this policy.

9. Changes to This Privacy Policy

We reserve the right to update or modify this Privacy Policy at any time to reflect changes in the law or our business practices.
